Two of the Kenyan suspects arrested in Mozambique in 2005 over alleged cross-border crime have died in a Tanzanian remand.

Ms Lydia Kwamboka, an advocate representing one of the suspects in remand, said the two bodies were brought home for burial and the remaining 10 suspects were waiting for their cases to be heard.

She identified the dead as John Odhiambo Odongo and Peter Mahera Kariba.

Kwamboka said six of the suspects were acquitted last year but the court ordered that they remain in custody to face other related charges.

The court, however, dismissed the case in which they were charged with stealing Sh44 million from a Forex Bureau.

Police in Maputo arrested the 12 over alleged criminal activities on December 16, 2005, but a judge later released them.

Kenyan police officers led by the then Nairobi Provincial Criminal Investigations Officer, Sammy Githui, flew to Maputo and handed over the suspects to the Tanzanian authorities.

In a joint affidavit filed by the suspects at the High Court in Moshi in June 2006, they claim Tanzanian authorities had kidnapped them from Maputo.

On June 1, 2006, the High Court in Tanzania allowed the suspects to file a case to counter the alleged forceful kidnapping and abduction from Maputo.

Justice J Mkwawa said the suspects had an arguable case that warrants the immediate interference of the court in exercise of its supervisory jurisdiction.
